October 8 - RAC Appeals Process


Overview: September 24 The HDI road show has come to Nebraska. Providers in this State are now on notice that audits can begin at any time. This next session in the RAC series will follow up on the information gained from the RAC statewide meetings. With all the current RAC review issues on the table, should providers try to get ahead of the RACs? This session will also explore the use of various case management protocols and external criteria as part of the provider’s admissions review process, and discuss any limitations on such process based on Nebraska law.

Overview: October 8 Discussion period, redetermination, reconsideration, Administrative Law Judge appeals and the federal district court. What are the distinctions between these processes? Where can we expect success on appeal? How much work will be involved in appealing? Can we do this internally? How should we decide what cases to appeal? Should we try to prevent recoupment pending appeal? What defenses can we raise? And when will it be reasonable to give up? This session will address these questions, and assist attendees in reaching their own conclusions, as appropriate to their facilities and other Medicare providers.

Faculty: Vickie Brady Ahlers & Barbara Person, Baird Holm LLP

Vickie Brady Ahlers is a member of the Health Care Section of the firm. She represents health care clients with respect to a variety of issues, including regulatory, transactional and contracting issues, HIPAA, medical staff and allied health professionals
issues, and organizational compliance. In 1998, Ms. Ahlers received her law degree, summa cum laude, from Southern Illinois University School of Law, where she served as Managing Editor of the Southern Illinois University Law Journal. In 1994, she graduated, summa cum laude, with a Bachelor of Arts in English from the University of Nebraska at Kearney. Prior to joining the firm, Ms. Ahlers served as a clerk for the Honorable James L. Foreman, District Judge for the United States District Court for the Southern District of Illinois. In 1997, she also served as a clerk for the United States Attorney’s Office. Ms. Ahlers has spoken to numerous industry groups, such as the American Hospital Association and the Health Care Compliance Association,
on the topic of privacy and security for healthcare providers, insurers and employers. She is listed in The Best Lawyers in America 2008 for her work in Health Care Law.

Barbara E. Person is a member of the Health Care Section of the firm. She primarily represents health care clients, concentrating on corporate compliance, Medicare and Medicaid reimbursement, Medicare fraud and abuse, EMTALA, physician practice and other health business acquisition, medical staff and allied health professional issues, tax exemption,
provider licensure and sanctions, physician contracts, pharmacy and nonprofit corporations. Ms. Person served as law clerk to the Honorable William C. Hastings, Judge, Nebraska Supreme Court from 1985 to 1986. Ms. Person is licensed to practice law in Nebraska and Iowa. She is a member of the Nebraska State Bar Association, the Iowa State Bar Association, the American Bar Association, the Omaha Bar Association and the American Health Lawyers Association. Ms. Person is included on the 2009 Great Plains Super Lawyers list and The Best Lawyers in America 2009 list for her work in Health Care Law.
